Make sure you are running the sqlplus from the correct home ie the infrastructure home where the database is installed.
Your absolutely correct. The enviro vars were set to portal and when switched it worked as expected, I just got a nice 30 minute overview of the apps server / portal of which I have no experience.
So I am just about done copying reports over and will install to /portal and not /infra - I think I will first check and see if its already there, who knows.

did you install the patches that are requird for redhat 3 before hand? (patch 3006854) as listed in the requirements
No I was sitting next to the unix admin, actually we are in the same cube for now and he was quite helpful, said it was all up to snuff and there is already Oracle portal on the box. Then I got the error and he tried that update process but it did not work. He bailed to the colocation facility and is now fighting other fires.
Wondering if I can get that patch and install it myself. I suppose it wont break whats already there, we have a room full of testers hammering this box.
I will go looking for the patch, weird thing is I cannot find forms/reports install guide for linux, just the one for Solaris. I assumed they put out the Solaris flavor and left the rest to us.
